These Terms and Conditions (“Terms”) govern your access to and use of Hirium’s website, software, services, and platform (collectively, the “Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Introduction
Hirium is an AI-powered Applicant Tracking System designed to assist companies with recruitment, candidate tracking, and workflow management. These Terms apply to all users, including individuals and organizations, who access or use the Service. Hirium reserves the right to update or revise these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
Eligibility
You represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into these Terms. You further represent that, if accessing the Service on behalf of a company, you are authorized to do so and to bind the company to these Terms. You agree to provide accurate, complete, and current information when registering and using the Service.
Account Registration and Security
To access certain features of the Service, you may be required to create an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify Hirium immediately of any unauthorized use of your account. Hirium reserves the right to suspend or terminate accounts for violations of these Terms or for any activity that compromises the security or integrity of the Service.
Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You shall not
- interfere with the operation of the Service,
- attempt to gain unauthorized access to any part of the Service,
- upload, post, or transmit any content that is illegal, harmful, threatening, defamatory, obscene, or otherwise objectionable, or
- use automated tools to extract data from the Service. Hirium reserves the right to monitor and enforce compliance with these rules.
Service Availability
Hirium endeavors to provide continuous and reliable access to the Service. However, the Service may be unavailable from time to time due to maintenance, updates, technical issues, or circumstances beyond Hirium’s control. Hirium does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Subscription, Payment, and Free Trial
Hirium offers paid subscription plans and, in some cases, free trials with specific limitations. All fees are as specified at the time of purchase or subscription. Payments must be made in full and on time, and subscription fees are non-refundable except where required by law. The Service may automatically renew subscriptions unless cancelled in accordance with the subscription agreement. Hirium reserves the right to modify pricing, plans, and billing policies upon notice to the user.
AI Features and Limitations
The Service includes AI-powered functionality to assist with candidate screening, scoring, workflow automation, and analytics. You acknowledge that AI outputs are provided for informational purposes only and are not a substitute for human judgment. Hirium does not guarantee the accuracy, reliability, or appropriateness of AI suggestions, and you are solely responsible for all decisions made based on the Service.
Intellectual Property Rights
All intellectual property rights, including but not limited to software, trademarks, logos, graphics, documentation, and content, are owned by Hirium or its licensors. Except for the limited license granted to access and use the Service in accordance with these Terms, you do not acquire any rights, title, or interest in the Service. Any unauthorized use of Hirium’s intellectual property is strictly prohibited.
Customer Data and Privacy
You retain ownership of all data you upload, input, or otherwise submit to the Service, including candidate information, resumes, and related content (“Customer Data”). Hirium will use Customer Data only to provide and improve the Service, and may use anonymized or aggregated data for research and analytics. By using the Service, you consent to the processing and storage of Customer Data as described in Hirium’s Privacy Policy.
Third-Party Services and Integrations
The Service may integrate with third-party services, such as email providers, calendars, and job boards. Your use of such third-party services is subject to their respective terms and policies. Hirium is not responsible for any errors, interruptions, or losses caused by third-party services, and inclusion of third-party features does not imply endorsement.
Termination
Hirium may suspend or terminate your access to the Service immediately and without notice if you violate these Terms, misuse the Service, or fail to pay subscription fees. Upon termination, you may request a copy of your Customer Data within a reasonable time. Hirium may retain certain data as required by law or for legitimate business purposes.
Limitation of Liability
To the maximum extent permitted by applicable law, Hirium, its affiliates, officers, employees, or partners shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, business, data, or goodwill, arising from or in connection with your use of the Service. The Service is provided on an “as is” and “as available” basis without warranties of any kind.
Indemnification
You agree to indemnify, defend, and hold harmless Hirium, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Service, violation of these Terms, or infringement of third-party rights.
Governing Law and Jurisdiction
These Terms and your use of the Service are governed by the laws of the State of Madhya Pradesh, India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Madhya Pradesh, India.
Changes to Terms
Hirium reserves the right to modify or update these Terms at any time. Updated Terms will be posted on the website with a revised “Last Updated” date. Your continued use of the Service after any such changes constitutes acceptance of the revised Terms.
